01 / Acceptance of Terms & Scope

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “Client”, or “you”) and Infortts Organization (“Infortts”, “we”, “us”, or “our”). By accessing our websites (infortts.com, infortts.site), utilizing our autonomous agent services (including Meeseeks, Pikaia, Acritarch, and Mitochondria), connecting via authorized third-party APIs (such as Meta Graph API or Telegram MTProto), or running our mobile and desktop applications, you certify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not accept these Terms in their entirety, you must immediately terminate access and discontinue use of all Infortts platforms.

02 / Eligibility & User Representations

By using Infortts platforms, you represent and warrant that:

• You are at least eighteen (18) years of age and possess full legal capacity to enter into binding agreements.
• You are not a citizen or resident of any jurisdiction subject to comprehensive international trade sanctions or embargoes (including OFAC, EU, and UN sanction regimes).
• Your use of our algorithmic tools complies with all local, statutory, and financial market laws applicable in your jurisdiction.
• All registration information and API credentials you provide are truthful, accurate, and current.

04 / Intellectual Property Rights & Limited License

All proprietary software, neural model weights, algorithmic rule sets, UI design systems, source code, documentation, APIs, and brand assets associated with Infortts Org remain the sole and exclusive intellectual property of Infortts Organization.

Subject to compliance with these Terms, Infortts grants you a revocable, non-exclusive, non-transferable, non-sublicensable limited license to access and interact with our platforms. You agree not to:

• Reverse engineer, decompile, disassemble, or derive the underlying source code of our autonomous services.
• Scrape, harvest, or extract algorithmic trading models or heuristics without explicit written authorization.
• Remove, alter, or obscure any proprietary copyright or trademark notices.

05 / Acceptable Use & Prohibited Conduct

You agree to utilize our platforms solely for lawful purposes. You shall not:

• Transmit malicious code, viruses, trojans, or automated scripts intended to disrupt or overwhelm our clusters (including denial-of-service attacks).
• Attempt unauthorized penetration testing, port scanning, or vulnerability probing against our domains, tunnels, or endpoints.
• Use our agent swarm to conduct fraudulent social engineering, phishing, or harassment across integrated communication channels.
• Engage in abusive practices violating third-party platform terms (including Meta Platform Policies, Telegram Terms, or Cloudflare acceptable use).

06 / Third-Party Integrations & External Services

Infortts interfaces with third-party platforms, including but not limited to Meta Platforms (Instagram Graph API), Telegram MTProto, Evolution WhatsApp Bridge, and MetaTrader 5 execution gateways. Infortts is not responsible for the availability, terms, fee structures, or policies of these external services. Your interactions with third-party providers are governed exclusively by their respective legal agreements.

07 / Disclaimer of Warranties

PLATFORMS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INFORTTS DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR PLATFORMS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE IMMEDIATELY CORRECTED.

08 / Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL INFORTTS ORGANIZATION, ITS FOUNDING DIRECTORS, ARCHITECTS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• TRADING DRAWDOWN, CAPITAL LOSS, OR MISSED MARKET OPPORTUNITIES;
• LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL;
• SERVICE OUTAGES, HARDWARE FAILURES, OR BROKER API DISCONNECTS;
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR TELEMETRY.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS EXCEED THE GREATER OF ONE HUNDRED US DOLLARS ($100.00 USD) OR THE AMOUNT PAID BY YOU TO INFORTTS IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

09 / Indemnification

You agree to defend, indemnify, and hold harmless Infortts Organization, its officers, directors, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with your violation of these Terms, your use of our algorithmic software, or your infringement of any intellectual property or third-party rights.

10 / Termination & Suspension

Infortts reserves the right, in its sole and unfettered discretion, to suspend or terminate your access to all or part of our services, APIs, or platforms at any time, with or without prior notice, for conduct that violates these Terms or is harmful to our infrastructure, other users, or third-party partners.

11 / Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms shall be settled by binding individual arbitration. You expressly waive any right to participate in a class-action lawsuit or class-wide arbitration.
